Job Summary

Responsible for Risk Management activities to administer cost effective plans to minimize liability and instill effective decision-making, process, and coverage to ensure loss control. Oversees procurement and contracting functions for the county ensuring proper purchase of goods and services for operational and capital projects/expenses. Engages personally and through others in negotiations and risk mitigation of complex county contracts and policy and process development to ensure legal and statutory requirements are adhered to and followed throughout the procurement life cycle. Responsible for vendor management and accountability to ensure deliverables and expectations are met. Provides supervision to assigned staff.

Job Description

ESSENTIAL DUTIES

  • Directs and/or facilitates the integration of risk information including risk assessments and the status of mitigation actions. Implements, enhances, or maintains a repository of risk assessment/measurement information.
  • Aggregates, analyzes, and reports risk information to county leadership and the Board of Commissioners.
  • Negotiates contracts on behalf of the county. Serves as the lead and works collaboratively with business units to negotiate highly complex contracts for enterprise software systems as well as other services. Identifies and mitigates contract risk throughout negotiations.
  • Resolves contract disputes on behalf of the county. Works collaboratively with County Attorney’s Office as warranted. 
  • Leads and manages county-wide purchasing and contracting for materials, vehicles, supplies, services, equipment, and Capital projects. 
  • Oversees and ensures organization's purchasing, contracting, data privacy, and risk management policies and strategies are in compliance with applicable regulations, rating agency standards, and strategic objectives of the organization. 
  • Reviews and provides recommendations on all countywide contracts, Request for Proposals (RFPs), Joint Powers Agreements, mutual aid, software licensing agreements, grants, Letters of Understanding (LOUs), facility use agreements, and Memorandums of Agreement (MOAs) for organizational risk issues, including insurance requirements and liability. Makes recommendations to departments on identified risks. Maintains comprehensive loss data in order to continue to develop risk control programs. Updates County Boiler Plate Contract.
  • Manages the process to monitor certificates for compliance with contract requirements. Obtains certificates of insurance for others where the county is naming them as an additional insured entity (e.g., bonds, banks, etc.). 
  • Manages all necessary insurance coverage, including auto, property/casualty, general liability, builders risk, law enforcement liability, employment practices liability, public officials' liability, etc. 
  • Manages claims for auto liability, general and professional liability, and property/casualty claims against the county. Works with supervisors on claims reporting and accident investigation. Directs the processing of claims and coordinates settlements. Maintains accurate claims records.   
  • Supervises assigned staff; recommends hiring and disciplinary actions; evaluates performance; orients new staff; and ensures necessary training is provided to staff.
  • Gathers information, analyzes, and makes recommendations on losses, property values, and operational changes to provide to Minnesota Counties Intergovernmental Trust (MCIT) for insurance purposes. 
  • Manages property schedules to determine coverage required. Oversees annual insurance coverage review.   
  • Processes and manages lawsuits against the county. Acts as county liaison and gathers documents and evidence for our attorney, provides witness lists, meets with attorney to discuss cases, and develops theories of defense. Responds to all interrogatories. Attends depositions and court hearings as needed. Represents the county in legal and administrative proceedings related to suits. Keeps stakeholders informed.
  • Resolves conflicts; handles disputes related to county-wide contracts and purchases.  
  • Evaluates and monitors vendors' financial reports, performance, and compliance with laws, rules, and regulations; compares programs and fiscal data between similar contracted services to establish service standards and to evaluate risk.  
  • Monitors key risk and procurements trends and leads strategic impact evaluation.  
  • Establishes and monitors key performance indicators and other attributes related to Risk Management and Procurement program effectiveness.  
  • Performs supervisory duties as defined in MN Statute 179A.03 Subd. 17.
  • Works the days and hours necessary to perform all assigned responsibilities and tasks. Must be available (especially during regular business hours or shifts) to communicate with other employees, supervisors, customers, vendors, and any other person or organization with whom interaction is required to accomplish work and employer goals.  
  • Performs other duties as required or assigned.

MINIMUM QUALIFICATIONS


Requires equivalency of a Bachelors' Degree (Master's Degree or advanced business degree preferred) in Business Administration, Public Administration, or related field and six years of experience managing and leading risk management, procurement, and/or contracting activities for a large department or organization. A reliable form of transportation for the performance of work responsibilities is required.

PREFERRED QUALIFICATION(S)

Preference given for Associate in Risk Management (ARM) or Chartered Property and Casualty Underwriter (CPCU), or Internal Auditor certification.

SUPERVISORY CONTROLS


The employee is under the general guidance and direction of the Transformation and Enterprise Services Director. Employee uses independent judgment, initiative, and discretion consistent with policies and other relevant statutory and regulatory requirements in performing the duties of the position. Work is reviewed through conferences, written reports, objectives achieved and quality controls of the federal/state regulatory agencies as well as those developed within the program. 

The incumbent directs and oversees the work of others; including, program/service planning and delivery, personnel selection, evaluation of work performance, training, and disciplinary activities. Performs supervisory duties as defined in MN Statute 179A.03 Subd. 17.

WORK ENVIRONMENT AND PHYSICAL DEMANDS


Typical characteristics of the regular, ongoing work environment of this position requires inside work, typically in an office setting. The position is multi-task oriented and includes periods of stress when balancing multiple and varied needs/demands of services.

Physical activities include sedentary to light work: Reaching, sitting, standing, walking, pushing, lifting, pulling, fingering, grasping, feeling, stooping, talking, hearing, seeing, and repetitive motions. Lifts and/or navigates up to 35 pounds on a routine basis in handling files and equipment necessary for performing the essential duties of the job.
